Delaware Courts Implement Modest Increase in Fees

 Consistent with budget language adopted by the Delaware General Assembly, the Delaware Judiciary recently implemented a modest increase in a variety of court fees to help the state courts to cover increased costs of operation. 

The increase is also designed to make important investments in the justice system that will benefit litigants, the Bar and the public.  The increases are not across-the-board but instead are targeted and limited to a handful of fees in each court. The amount of each fee increase was also carefully reviewed by each court for reasonableness and to ensure that any adjustment did not act as a barrier for lower income litigants. Some of the increases were part of a phased increase of certain fees that began in 2015 and will be completed this year. The increases took effect on August 15, 2018 and have been adopted by orders or amendments or internal procedures approved by Judicial Officers of the Delaware Supreme Court, the Court of Chancery, Superior Court, Court of Common Pleas, Family Court and the Justice of the Peace Court.  Additional information including a list of fees affected can be found on the Delaware Courts’ rules page at https://courts.delaware.gov/rules/.
